2025 JANM Lexus Opportunity Drawing Official Rules

The 2025 JANM Lexus Opportunity Drawing is sponsored by the Japanese American National Museum (JANM). Individuals ineligible to participate in the 2025 JANM Lexus Opportunity Drawing (Drawing) are as follows: JANM and Lexus, a Division of Toyota Motor Sales, U.S.A., Inc. (Lexus) employees and individuals living in the same household as JANM or Lexus employees, officers, directors, shareholders, employees, agents, representatives, dealers, dealer associations, advertising agencies, and contractors of JANM or Lexus, or either of their parent, subsidiaries, and/or affiliates, individuals who will not have attained the applicable age of majority in his/her state of legal residence by April 2025, individuals who are not legal residents in the continental US, Hawai‘i, or D.C., and individuals who do not possess a valid US driver’s license. Drawing entries available for purchase, as follows: by mail to JANM, 100 North Central Avenue, Los Angeles, CA 90012; by email at specialevents@janm.org, or by phone at 213.830.5646. Only official Drawing Entries will be accepted. No photocopies permitted. Void where prohibited or restricted by law. One winner (Winner) will be chosen by random drawing from all eligible Drawing Entries (Drawing), at the JW Marriott Los Angeles on April 12, 2025, to receive a 2024 Lexus TX 500h F Sport Performance with a manufacturer’s suggested retail price of $79,650 (Prize Vehicle). The Winner must be able to present evidence of adequate insurance in order to receive Prize Vehicle. Winner is subject to verification of compliance with these Rules and Regulations and may be required to execute a liability release and affidavit of eligibility/publicity release. The Prize Vehicle shall only be delivered in the continental US, Hawai‘i, or D.C. at a location and within a delivery period designated by JANM. JANM shall take all reasonable efforts, subject to availability, to deliver the Prize Vehicle within 120 days of completion of the Winner verification process. Winner shall bear all risk of loss or damage to the Prize Vehicle after it has been delivered to the specified delivery site. Winner must personally retrieve the Prize Vehicle within thirty days of written notification of delivery. Winner is responsible for income and other taxes, license, title, registration, and other expenses associated with receiving the Prize Vehicle. Prize Vehicle is nontransferable (e.g., Winner must take title to Prize Vehicle) and no substitutions for cash or any other prize(s) permitted (although JANM may substitute an alternate prize of comparable or greater value at its sole discretion). The depiction of the Prize Vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the Winner. JANM will determine all features of automobile including, but not limited to, color of exterior and interior, and all other features or upgrades will be allowed only if permitted by delivery dealer and paid for by Winner. Winner must be a US licensed driver and will be required to provide proof of valid US driver’s license and legally required insurance at time of delivery (or an alternative winner shall be selected if applicable and the original winner’s rights to the Prize Vehicle shall be automatically forfeited). Winner must take delivery of Prize Vehicle from the automobile dealership designated by JANM. JANM shall not be responsible for delays in delivery of the Prize Vehicle, and delivery is subject to availability. Prize Vehicle is subject to withholding tax at a 24% rate (subject to change) which will be collected by JANM. Acceptance of Prize Vehicle constitutes permission for JANM and Lexus and/or their designees to use the Winner’s name, address, photograph, testimonial, or other likeness and/or Prize Vehicle information or personal exposition (and/or any edited portion thereof) for promotional, advertising, and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, the Winner to the greatest extent permitted by law. As a condition of participating in the Drawing, participants agree and consent to JANM’s collection, use, and retention of their personal and other information for all purposes related to the Drawing (including, without limitation, processing and administering Drawing entries or Prize Vehicle claim, sharing participants’ personal information with third parties, including Sponsor’s service providers, contractors, Prize Vehicle partner, etc., as necessary, to conduct and operate the Drawing, communicating with and awarding Prize Vehicle to Winner, making public announcements about Winner, and advertising, promotion, and publicizing the Drawing), and to comply with applicable laws, rules, and regulations, including the storing of participants’ information for purposes of complying with state record retention requirements. Information collected from participants will be subject to JANM’s Privacy Policy, published at janm.org/about/privacy. If any participant objects to anything stated in these Official Rules or JANM’s Privacy Policy, they should not participate in the Drawing. If any participant is a California US resident and wishes to review what choices and rights you are afforded under the California Consumer Privacy Act (CCPA) or other applicable California privacy laws, they should review that section of US Sponsor’s Privacy Policy using the link provided above. Drawing participants agree to release JANM and Lexus and all of their respective affiliates, directors, officers, employees, and contractors from responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with any individual’s participation in the Drawing or in connection with acceptance or use of the Prize Vehicle, provided, however, that Lexus shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner’s Guide for the Prize Vehicle for the term set forth therein. Odds of winning the Prize Vehicle depends on the number of eligible Drawing Entries received. Drawing will be held in compliance with all federal, state, and local laws. Nondeductibility of Drawing Entries: The IRS has taken the position that amounts paid for changes in lotteries, or similar drawings for valuable prizes are not gifts, and consequently, the purchase of a Drawing Entry does not qualify as a deductible charitable contribution.
